Terms of Service

We provide technical operations services including, but not limited to:

• Web design and development (WordPress, GHL).
• CRM setup, funnels, and automation configuration.
• Digital strategy consulting and technical audits.
• SaaS operations management.

Specific deliverables, timelines, and fees will be defined in a separate Proposal or Statement of Work (SOW). The SOW always overrides any conflicting term found here.

To ensure project success, you agree to:

• Provide timely feedback, content, and login access as requested.
• Obtain all necessary copyright/licensing rights to any media or text you supply.
• Pay invoices on or before the due date.

Impact of Delays: Delays in providing inputs or payments will pause our obligations and may shift project deadlines significantly.

• Currency: Prices are quoted in US Dollars (USD) or Philippine Pesos (PHP) as stated in the SOW.
• Terms: Unless noted otherwise, 50% is due to commence work, and the balance is due upon project delivery.
• Subscriptions: Monthly fees (e.g., Retainers) are charged automatically via our third-party processors (Stripe, PayPal, Wise).
• Late Fees: Late payments incur 2% interest per month or the maximum legal rate.

Our IP: We retain ownership of our pre-existing code, frameworks, snapshots, and internal tools.

Your License: Upon full payment, you receive a worldwide, non-exclusive, perpetual license to use the final work product for its intended purpose.

Portfolio Rights: You grant us permission to display your company name and finished work in our portfolio, unless explicitly revoked in writing.

We build systems on third-party platforms including, but not limited to GoHighLevel, WordPress, Stripe, and Twilio.

GoWithJeng does not own or control these platforms. We are not liable for downtime, feature removals, pricing changes, or data loss originating from the platform provider. We are an independent consultancy, not an employee of these platforms.

Services are provided "as is" and "as available." While we aim for technical excellence, we cannot guarantee uninterrupted or error-free operation of software.

To the fullest extent allowed by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Cap on Damages: Our total liability under any SOW is strictly capped at the amount you paid for the specific service giving rise to the claim.

Exclusions: We are not liable for indirect, incidental, or consequential damages, such as lost profits, data loss, or business interruption, regardless of the cause.

For Cause: Either party may terminate with 14 days' written notice if the other materially breaches the agreement and fails to cure it.

Subscriptions: You may cancel recurring services by giving 30 days' written notice before the next billing cycle. No refunds are issued for partial months.

Payment Due: Fees for all work performed up to the date of termination remain immediately payable.
